Application of general terms and conditions

These general terms and conditions apply to all orders and the entire contractual relationship established via the website http://www.mailbox-design.com with regard to the items offered on it. Before the agreement is concluded, you must tick during the ordering process to have read these general terms and conditions and to accept them in full and unconditionally. Mailbox-Design reserves the right to change the conditions. Any changes to the terms and conditions will apply to orders placed on or after the date of the change. Additional terms and conditions of the customer are excluded, unless they are exceptionally accepted in advance, in writing and expressly.

Right of withdrawal

As a consumer, you have the option of dissolving the contract without giving reasons and without costs other than the return costs during 14 calendar days, starting from the day following the delivery of the item.

If the consumer wishes to make use of this option, the articles must be returned in perfect condition, complete and undamaged and accompanied by the original labels and at their own risk and expense to 't Hoveniersbedrijf, Steenweg 109 - 3540 Herk- de-Stad (Belgium).

To comply with the withdrawal period, it is sufficient to send the communication concerning the exercise of the right of withdrawal within a period of 14 calendar days from the day following the delivery of the item. After this period has expired, it is no longer possible to cancel the purchase.

The article must then be effectively returned by the consumer within a period of 14 calendar days, counting from his notification to withdraw from the agreement. The return must be made to 't Hoveniersbedrijf, Steenweg 109 - 3540 Herk-de-Stad (Belgium).

The costs for return shipment are the sole responsibility of the consumer.

The consumer cannot exercise the right of withdrawal for:

• service agreements after the full performance of the service;
• the delivery of goods manufactured according to the customer's specifications, or which are clearly intended for a specific person;
• the supply of goods that spoil quickly or with a limited shelf life;
• the delivery of sealed goods that are not suitable for return for reasons of health protection or hygiene and of which the seal has been broken after delivery;
• the delivery of goods that are irrevocably mixed with other products after delivery due to their nature;
• agreements where the customer has specifically requested to visit him to carry out urgent repairs or maintenance.

Mailbox-Design can exclude the consumer's right of withdrawal for articles that have been created with the consumer's specifications. If this is the case, the consumer will be expressly informed that he/she does not have a right of withdrawal.

If the consumer makes valid use of his right of withdrawal and has returned the items in accordance with the required conditions, Mailbox-Design will refund the returned items as soon as possible when they have received these items back in the correct condition.

Prices

All prices displayed are:

• in euros (€),
• including VAT,
• excluding shipping costs,
• each, unless otherwise stated.

The price indication refers exclusively to the articles as described verbatim. The accompanying photos are decorative and may contain elements that are not included in the price.

The price stated at the time of the order always applies to an order. The shipping costs are clearly stated during the ordering process. Mailbox-Design reserves the right to change and correct the prices of the articles and the information about the articles without prejudice to the binding orders.

Failure to pay on time

In the event of late payment of an invoice, default interest of 8% will be due by operation of law and without further notice of default from the due date of the relevant invoice or account until the date of full payment.

In the event of full or partial non-payment on the due date of an invoice, the defaulting customer will also owe a fixed amount of 10% of the invoiced amount by way of contractual compensation and in addition to legal costs. minimum of 40 euros per invoice.

In case of non-execution of the agreement, such as refusal of delivery or cancellation by the customer, Mailbox-Design.com is entitled to a fixed compensation of 20% of the amount due with a minimum of 75.00 euros and a maximum of 2500.00 euros. In the event of default by Mailbox-Design.com, an equivalent compensation is due to the customer.
